In order to purchase the products that DEM Industrial supplies, you must read and accept the following Terms and Conditions stated below.
Using our services and buying our products implies that you have read and accepted the Terms and Conditions of Use stated herein.
Refund and warranty policy
Unless otherwise stated, our products are supplied with a 12-month warranty.
Under no circumstances will this company be liable for any damage including direct, indirect, special, fortuitous or consequential damages or other losses resulting from the use or the impossibility of using our products.
The guarantee does not cover breakdowns or damages caused as a result of undue use of the product. The warranty terms are associated with manufacturing faults and operational faults under the normal conditions of the products and these terms will only become effective if the equipment has been used correctly. This includes:
- In accordance with the technical specifications stated for each product.
- In environmental conditions in line with the specifications detailed by the manufacturer.
- In specific use for its factory designed function.
- In electrical operation conditions in line with the specifications and tolerances stated.
Anti-fraud check
The customer’s purchase can be delayed for the anti-fraud check. It can also be suspended for a longer time for a more rigorous investigation, to avoid fraudulent transactions.
Privacy
This website www.demindustrial.com guarantees that the personal information you send has the necessary security. The data entered will not be sent to third parties unless it must be shared to comply with a court order or legal requirements.
Subscription to advertising emails is voluntary and can be selected when you create your account.
DEM Industrial reserves the right to change or amend these terms without prior notice.
International customers
For all deliveries that have to be exported outside of Spain, the country where DEM Industrial is located, this company will not handle the process of importing and nationalisation of the product for the internationalisation of such in the destination country and is equally not liable for the customs expenses and other costs that may arise during this process, unless otherwise stated.
The customer will be the party responsible for ensuring that the characteristics of the product to be imported fulfil the legislation of the destination country.
If the material is retained at customs for inspection, DEM Industrial will not be liable for any trace of tampering that the product or packaging may show.
Sales responsibility and services
None of the DEM Industrial sales representatives will be able to make declarations regarding the technical characteristics of the products we offer unless these are backed by written confirmation from the product supplier.
The price lists and other documents issued by DEM Industrial in relation to the products it supplies and to the services it offers can be amended at any time without prior notice.
Any lack of information or typographical error accidentally made by DEM Industrial in any document sent to the customer (quotes, price list, etc.) will be subject to correction and DEM Industrial will not be liable.
Products
No orders will be processed until the customer has previously received an official purchase order or written confirmation.
The products will only be supplied in the minimum amounts that the DEM Industrial suppliers stipulate, if the order does not reach said number of minimum units, the price will be readjusted proportionally.
The product images and descriptions, and other informative documents provided by DEM Industrial, will only serve for information and orientation purposes and will not be binding at any time.
No order requested and accepted by the customer can be cancelled by such, unless the supplier that supplies the material from such order to DEM Industrial accepts the cancellation.
DEM Industrial will under no circumstances bear any expenses that may result from the cancellation of the order.
Services
Since issuing the quote requested by the customer, DEM Industrial will render the services expressly detailed in said quote, always acting in good faith and doing everything possible to offer a high-quality service by fulfilling its obligations as a supplier, but without the delivery time being an essential factor in the fulfilment of these obligations, given that it is something that does not depend directly on DEM Industrial.
Prices of our products and services
The price of our products and services is that detailed in the quote issued by DEM Industrial, said price will have a validity of 30 days from the issue of the invoice. All of the materials are subject to prior sale and as such DEM Industrial cannot at any time guarantee how long the products quoted will be available for.
DEM Industrial reserves the right to modify the prices that appear on the quotes if any factor external to the company results in an increase in the price DEM Industrial pays to purchase from its supplier (changes in prices given by the plant or by the supplier, currency exchange fluctuations, government taxes, etc.).

Advance payments and credit accounts
All payments must be made as stated in the quote issued by DEM Industrial and previously accepted by the customer.
Orders from customers that do not have a credit account with DEM Industrial will not be processed until an official purchase order and proof of payment is received. If, on the other hand, the customer has a credit account, and the conditions of such account have been previously agreed upon by the two parties, the official purchase order will only be necessary to process the order.
DEM Industrial reserves the right to cut the credit line of any customer whose financial solvency is considered unstable, and consequently commercial actions can only be carried out with said customer provided that the payments are made in advance and in full.
National and international deliveries
DEM Industrial works with two Incoterms: EXW (Ex Works), which means at the seller’s plant or warehouse, and DAP, which means Delivered at Place at customs with no rights paid. The Incoterm with which all deliveries are made is EXW, unless otherwise stated. Before beginning the purchase process this must have been agreed upon by both parties and appear in the invoice issued by DEM Industrial and on the customer’s official purchase order.
The delivery date that appears in the quote and other commercial documents is indicative as there may be factors external to DEM Industrial that impede us from complying with said delivery time, and as such this company will not be liable for any delay in the delivery of materials, or of fines by the entity of the customer or other third parties affected by said delay.
Products faulty on delivery
If the product is faulty on delivery or if it is an unknown item, the customer must report this within no more than seven days. DEM Industrial will immediately proceed with one of the following options within 30 working days from receipt of the item, at no cost to the customer: repair or replace the product; if this is not possible, the customer will be reimbursed the full amount paid for the faulty item.
Products cannot be returned without the prior consent of DEM Industrial.
DEM Industrial shall have no liability to the customer other than that described above. The company is furthermore not liable for any other breakage that may arise from normal wear through usage, negligence or due to improper use of the product.
The customer must fulfil all of the legal governmental regulations for the use or resale of the products supplied by DEM Industrial. If our company is affected as a result of failure to comply with said laws, compensation will be established that the customer must pay to DEM Industrial.
Non-payment by the customer
If the customer has not made the payment before the invoice due date, DEM Industrial will be able to:
- Cancel the order or stop any delivery or service pending with the customer.
- Take the payment the customer has made for another product or service that has not been provided yet.
- Cancel any contract with the customer and DEM Industrial will have no liability towards the customer.
Responsibilities of dem industrial and its customers
DEM Industrial will not be liable at any time to the customer for any claim for compensation due to damages, financial loss or loss of profit, loss of business or of any other nature, whether this is a direct or indirect consequence of hiring any of the services offered by our company.
In the event of a delay in any of the services offered by DEM Industrial, it will not be considered that the company has violated any of these terms and conditions as there may be different factors external to DEM Industrial that impede the fulfilment of the delivery time.
If the customer’s company is constituted by one or more people, all of the terms and conditions herein will apply to all members of such.
None of the parties will be liable for the failure to fulfil, or delay in the fulfilment of, its obligations provided that this is due to a cause external to the parties, such as: natural catastrophes, non-fulfilment by a third-party provider, a cut in the electricity supply, strikes, governmental actions, etc.
People who do not form part of the contracts signed with DEM Industrial will not have any liability or conformity rights with any contract.
Confidentiality to be observed by dem industrial and its customers
Throughout the term of all of the contracts and their subsequent termination that DEM Industrial enters into with its customers, both parties must:
- Keep all of the information gathered in the contract, as well as the confidential data of each company, confidential.
- Not make use of any confidential information for reasons other than those stated in the contract.
- Guarantee that none of the members of each company will act in a manner that violates any of the clauses of these terms and conditions.
- Both parties may share any confidential information to any governmental body that requires such information.
Communications between dem industrial and its customers
All of the notices related with these terms and conditions or with any contract between DEM Industrial and its customers will be considered as correctly notified if signed by an authorized manager of the party issuing said notice.
In the case of a delivery, all notices will be considered as correctly notified when the delivery is made by a carrier or courier during the addressee’s working hours.
In the case of a delivery, all notices will be considered as correctly notified when a fax or email is sent and a report confirming correct delivery is generated.
All notices that the customers want to send to DEM Industrial must be sent to the most recent postal address or email address that the company used to get in touch with the customer.
Exchange service conditions
Once the replacement unit is received, the customer must take care of sending us the damaged unit within 10 working days, as long as it is in a reparable state, and provide us with the tracking number.
Unless otherwise agreed, the reference number of the replacement unit sent by DEM Industrial and the reference number of the reparable damaged unit sent by the customer must be exactly the same.
Discrepancies between terms and conditions
If there is any discrepancy between these terms and conditions and any other version of the same, that stated herein will prevail, unless otherwise stated.
